This privacy policy explains how we collect, use, disclose, and process, your personal data when you sign up for or participate in our Pilates and related fitness activities and classes (the “Programs”).

All references to “you” and similar words mean the individual participating in the Programs. All reference to “us” and similar words such as “we” mean Third Space Studio LLC, a Missouri limited liability company.

You accept this privacy policy when you sign up for a Program, participate in a Program, or continue to participate in a Program after we post an updated privacy policy. If you do not agree to this privacy policy, then you may not sign up for or participate in the Programs.

Information We Collect

We collect the following categories of personal data when you sign up for or participate in the Programs.

Personal data you or a third party provides to us:

  • Identity and Contact Information: Your name, address, email address, phone number, profile images, preferred gender pronouns, and similar information.

  • Physical Limitations: Limited information related to physical limitations you may have that may impact your ability to participate in the Programs.

  • Personality Characteristics: Information such as workout preferences, preferred Programing options, and similar information.

  • Account Information: Usernames, passwords, security questions, and similar information.

  • Payment Information: Payment information including credit and debit card numbers, account numbers, and similar information.

Personal data we receive automatically:

  • Device and Technical Information: Information about the device and software you use to access the platform we use to manage our Programs, including your IP address, location information, operating system name and version, browser name and version, internet service provider, and similar information.

  • Usage and Activity Information: Information about how you use the platform, including dates and times of access, pages you view, links you click, search queries, navigation paths, browsing history, performance stats, usage logs, errors (and associated features and application states), and similar information:

  • Cookies and Tracking Technologies: Cookies, cookie-equivalent technology, web beacons, pixel tags, and similar information (some of which may be stored data on your device and controlled by you).

How We Use Your Information

Aggregated & Anonymous Data: We may aggregate or de-identify your personal data to create anonymous data, which is not personal in nature, and which does not identify you as a specific individual or business. We may use anonymous data for any purpose not prohibited by applicable law, without your consent and without notice to you, including sharing or selling it to third parties.

Personal Data: We may use your personal data as follows:

  • Provision and Customization of Services: We may use your personal data to provide the Programs to you, as well as to customize and/or enhance your use of the Programs.

  • Payments: We may use your personal data to process purchases you make through the platform, including sharing your personal data and payment information with third party payment processors (for example, Walla and Stripe).

  • Communications: To send communications to you, including marketing communications (unless you opt-out).

  • Advertising: To serve customized ads to you.

  • Cookies & Tracking Data: You may restrict our ability to use cookies and certain other types of data files by adjusting the settings on your device or browser. However, please note that if you create such restrictions, all or parts of the platform may not operate as intended (or at all).

  • Retention: We may retain your personal data for as long as reasonably necessary for the purposes described in this privacy policy and our Membership Terms. We have no obligation to retain your personal data and may delete it at any time without notice to you. You may request that we delete your personal data from our systems, but we are not required to delete your personal data except as required in this privacy policy.

  • Compliance with Law & Legal Processes: We may use and share your personal data : (a) to comply with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms, (b) to respond to lawful requests by public authorities, including to meet national security or law enforcement requirements, (c) to prosecute and defend a court, arbitration, or similar legal proceeding, (d) with our representatives and advisors, including attorneys and accountants, and (e) if we have a good faith belief that disclosure is necessary to enforce our Membership Terms or any policies referenced in our Membership Terms or to investigate or prevent illegal or immoral actions.

Miscellaneous

Improvements: If you share ideas or suggestions with us regarding improving or modifying our Programs or other services, then we may use that information for any purpose without your consent, without providing notice to you, and without providing compensation to you.

Security: We use reasonable efforts to protect your personal data, including your payment information. However, the internet is not a completely secure environment, and we cannot guarantee the security of any information you transmit to us through the internet. You are responsible for maintaining the security of your account credentials.

Amendment: We may amend this privacy policy at any time, for any reason, with or without notice to you. Your continued use of the platform and/or participation in the Programs after we post the amended privacy policy constitutes your acknowledgment and agreement to the amended privacy policy. However, to the extent the amended privacy policy materially alters your rights or obligations, the amended privacy policy will become effective on the earlier of (a) your continued use or participation with actual knowledge of the amended privacy policy, or (b) 30 days after the amended privacy policy is posted.
